xQc Plans to Fight Olympic Committee on Twitch Ban
xQc’s Olympic ban on Twitch is not one that the’s taking lightly. These DMCA bans are supposed to be 24 hours, but his drug on for two days, which is incredibly suspicious. His response? He spoke to his legal team and xQc is going to file his own DMCA counter-claim to have that strike dismissed. It really puts a strain on things like “fair use”, when someone wants to create content based on the Olympics but gets punished for doing so. It’s one thing to simply be restreaming illegally and doing nothing with it, or even making money on it. But creating content based on an event should be perfectly fine by Fair Use.
Taking It to Court
During the “vacation” from Twitch, xQc apparently contacted his legal team about the Olympic ban. He talked about it on his return stream and gave some important details. He said that normally you don’t get immediately banned for DMCA strikes, but his was live while on the air, so he got punished straight away.
xQc asked his legal team if there was anything can be done. It seemed an unfair amount of time to be banned because of something like this, and the result is clear. xQc is going to issue a counter-claim against the party who issued the copyright strike. That’s right, he’s taking on the Olympic Committee in this. He called the strike against him “pretty ballsy” to boot.
Despite what the DMCA claim says, xQc is convinced that it falls into Fair Use and was transformative content (so not a deliberate restream). This could also cost xQc millions according to the livestream, but he and his team feel he’s in the right. It could get absolutely bonkers, depending on how the Olympic Committee responds to xQc and his original Twitch ban.
According to xQc, this could get “crazy crazy”. We’ll keep following this story as it develops, but as of now, xQc firmly stands behind his content.
