MTG War of the Spark Mythic Edition Lawsuit Moves to Federal Court

The complex circumstances surrounding the recent MTG War of the Spark Mythic Edition orders has now escalated yet another level. The case was recently held in the state courts in the United States but has since been elevated to the federal courts for the whole country.

Hasbro continues to note that the issues surrounding those orders is not the fault of it or developer Wizards of the Coast at all. As such, it has moved this class action lawsuit against it from the state courts to the federal courts for them to decide what the verdict of the lawsuit is.

How It All Began

This case all began well over a month ago on May 1. The class action lawsuit was filed by Werner Wetherington, P.C. in Atlanta, Georgia. The case has since gone from the state of Georgia courts to now the federal court. The class action lawsuit was created to represent thousands of customers.

These customers purchased the MTG War of the Spark Mythic Edition when it was on sale through eBay. Unfortunately, there were only a limited number of copies, and of course it sold out quickly. The odd thing is, though, that orders kept being accepted through eBay despite going well over the limit.

There were originally only going to be 12,000 copies sold through the marketplace but more than 30,000 orders were accepted in total by the time the listing ended for the MTG War of the Spark Mythic Edition. The likely reason for this unfortunate situation is because of some glitch in the system.

As you can imagine, fans were not happy one bit about this ordeal and understandably so. The class action lawsuit was created as a way to receive damages to compensate those who were affected by this situation and had a “confirmation of sale.” After all, many of those 30,000 orders were subsequently cancelled.

Wizards of the Coast did make it up to affected players for getting their orders cancelled since there wasn’t enough for everyone by beginning with a refund for their order. For some customers, though, they weren’t able to receive a refund for any of the shipping costs associated with the order.

Hasbro and eBay worked together to amend the situation by giving all affected players a $20 gift card code that can be used in another eBay order in the future as well as a full sheet of rare and Mythic Rare foil cards from the recent War of the Spark expansion, which is likely worth a good bit of money.

What Happens Next

The class action lawsuit is still going on, despite this, to compensate the affected players. However, Hasbro and Wizards of the Coast have denied that any of the fault behind this terrible situation is on them. Instead, they put the blame on eBay and a “third-party” for what occurred during the technical issues.

To Hasbro, this situation was entirely outside of its control and none of the issues are its fault, according to a Reddit post regarding this class action lawsuit. Wetherington believes that Hasbro will now attempt to dismiss the entire complaint since the case has been elevated from state courts to the federal level.

Oddly enough, the Reddit post has since been deleted entirely for unknown reasons. From here, Hasbro has until July 10 to make a response to the case. Stay tuned for more updates regarding this evolving class action lawsuit and the reasons behind why the post was deleted.
